General Contract Terms and Conditions

2. The GCTC and other documents

2.1. These “General Contract Terms and Conditions” (hereinafter: GCTC) set out the rules for using the services of the Bobo Fun Park adventure park operated by the Operator (hereinafter: Bobo Fun Park) as well as the related legal conditions and rules of conduct.

2.2. These GCTCs do not incorporate concrete, specific conditions, nor do they exclude the option of entering into separate agreements with travel agents and organisers at different terms and conditions as appropriate.

2.3. The detailed rules all Visitors to Bobo Fun Park must observe are described in these GCTCs and the Rules and Regulations.

2.4. Further, the Privacy Notice regarding data processing by Bobo Fun Park Kft. as controller, which also includes an information notice on the video surveillance system in operation, constitutes an attachment to these GCTCs.

2.5. Visitors confirm that they accept the GCTCs upon purchasing their ticket and booking online, and/or by completing and signing the Statement of Liability. The GCTCs and the documents referred to herein are available at the www.bobofunpark.hu website and at the Bobo Fun Park reception desk.

3. Visitors

3.1. A Visitor is a person who uses the services of Bobo Fun Park; in the case of minors, this definition includes both the minor and their legal representative of legal age and legal capacity or a person of legal age and legal capacity who is responsible for the minor pursuant to law or other legal relationships or authorisation from the legal representative.

3.2. If the purchase order for our services is submitted to the Operator by a third party (hereinafter: Agent) on behalf the Visitor(s), the terms and conditions for cooperation set out in the agreement between the Operator and the Agent shall apply. In such cases, the Operator is not under obligation to ascertain whether the third party has the legal right to represent the Visitor.

4. The services of Bobo Fun Park

Bobo Fun Park is an indoor leisure centre and events space offering a place for active, athletic recreation and leisure mainly to children above the age of 6 as well as adults. The basic services of Bobo Fun Park:

  • Climbing upwards on the slide is forbidden.
  • Do not climb up the net either on the inside or outside.
  • Sit down when you are on the slide!
  • Always wear Fun Park socks.
  • We request parents/accompanying adults to explain the detailed rules to the children in their care.
  • Make sure your child is not wearing loose clothing or any loose laces or drawstrings.
  • Keep your eye on your child at all times! This play equipment is for children only. Naturally, this does not mean that you should not go in if your child asks you for help.
Laser labyrinth Over 8 years of age
  • Max. play time 5 minutes per turn. Once your time is up, let others play! You can always come back later.

  • Do not climb up the net either on the inside or outside.
  • Always wear Fun Park socks.
  • We request parents/accompanying adults to explain the detailed rules to the children in their care.
  • Never allow children older than 6 years into the play area!
  • Make sure your child is not wearing loose clothing or any loose laces or drawstrings.
  • Keep your eye on your child at all times! An accompanying adult must actively supervise at all times.

5. Contractual relationship

5.1. The Operator and the Visitor enter into a contractual relationship through the ticketing process, upon the payment of the full price of the ticket. Tickets may be purchased online or on site. If made verbally, bookings, orders and subsequent modifications shall have no legal effect.

5.2. The contract between the parties shall last from the time of booking or ticketing to the time the Visitor leaves Bobo Fun Park.

5.3. Bookings for events will be confirmed once the deposit specified in the written contract has been paid.

6. Prices

6.1. The prices for services and other fees are listed on the webpage www.bobofunpark.hu/en/prices and displayed at reception at Bobo Fun Park.

6.2. The Operator shall have the right to alter its pricing at its discretion and without announcing such changes in advance, unless it has made a price commitment for a specific period of time.

6.3. Prices are inclusive of sales tax (VAT), at the rate regulated by the law. The Operator shall have the right to pass on to ticket buyers the extra cost arising from a change in sales tax (VAT) rates.

6.4. Current discounts, promotions and other offers are announced on the webpage www.bobofunpark.hu. Discounts are only available if visitors indicate their entitlement for the discount before buying a ticket, and they can also verify it with the appropriate document (e.g. an identity card in the case of a birthday discount). It is not possible to claim a discount on a ticket already purchased or to refund any possible price difference.

6.5. For custom requests, groups, corporate events and promotions, the Operator shall have the right to set custom prices.

7. The ticketing process

7.1. Tickets may be purchased online and on site and must be paid for right away.

7.2. On site, tickets are sold only if capacities are available.

7.3. Bookings via the website are available for a maximum of 25 persons simultaneously.

7.4. If tickets are booked for multiple individuals, the person making the booking is responsible for informing the Visitors accompanying them regarding the terms of use and the Rules and Regulations.

7.5. The Operator shall not be responsible for any losses and errors arising from the incorrect provision of data during the online ticketing process.

7.6. The Operator confirms the successful ticket purchase by sending an e-mail to the e-mail address specified during the booking. If Visitors do not receive this e-mail within 2 hours and cannot find it in their spam or junk folder either, they are kindly requested to contact our customer service.

7.7. Online ticketing is possible until 1 hour before the start of opening hours at the latest.

7.8. On site, tickets purchased online can be presented in printout or on a smartphone.

8. Payment conditions

8.1. Accepted forms of payment:

8.2. The success of the online payment will be confirmed by the Operator in an e-mail.

8.3. Regardless of the payment method, the associated costs shall be paid by the Contracting Party and charged to their credit card.

8.4. Travel agencies / Tour operators / OTAs / Cooperating partners: the special payment terms applicable are set out in the agreement with the Operator; payment terms may change in the case of special offers, and will be set out in the written confirmation.

9. Changes to bookings

9.1. After purchasing the service, Visitors may make changes to their purchased tickets up to 48 hours prior to the time booked. Subject to the same conditions, the time booked may be changed within 90 days, in accordance with the capacities available.

9.2. Tickets will not be redeemed or converted to gift vouchers, and gift vouchers will not be converted to cash.

9.3. With custom and promotional offers, the modification conditions in that offer shall apply. The Operator maintains the right to exclude or restrict the right of cancellation and modification during its promotions.

9.4. Tickets purchased may be transferred to other persons and may be converted to tickets of a higher price, although not a lower price. The difference shall be paid on site.

9.5. No cash compensation is offered for services booked but not used.

10. The use of the services

10.1. Visitors purchase a ticket for a single entry for a 4-hour time slot. Arrival is from 30 minutes prior to the start of the 4-hour slot.

10.2. If a Visitor arrives late, this will not alter either the expiry of their time slot or the amount of the service fee.

10.3. Upon arrival, Visitors must present their ticket purchased online or may buy a ticket on site if there are available capacities.

10.4. Prior to entry, the Visitor or their legal representative or supervisor shall complete and sign the Statement attached to these GCTCs to declare their liability and accept the GCTCs and the Rules and Regulations. A Statement of Liability must be completed for all Visitors (regardless whether they are minors or of legal age). The visitor’s Statement of Liability for minors shall be completed by the legal representative of legal age and legal capacity or a person accompanying/supervising the minor, who is authorised for such supervision by the law or other legal relationships, or by the legal representative. The person completing the Statement shall be responsible for the information filled in and the truthfulness of the data provided. The Statement is available at the following link: bobofunpark.hu/en/statement-of-liability. Completing and signing the Statement is a precondition for entry.
The Operator shall have the right to verify the identity of the person completing/handing in the Statement as well as that of the persons included therein. To this end, the operator’s staff may request Visitors to show their personal ID cards, driving licences, passports or residential address cards. The Operator will not accept Statements of Liability that are incomplete or contain untrue data. If the missing data cannot be provided or corrected, or if the Operator discovers any fraud concerning a ticket, the Operator shall have the right to refuse service. In such cases, Visitors shall not have the right to demand compensation or the reimbursement of the ticket price.

10.5. The Operator maintains the right to require persons above the age of 18 to present a coronavirus immunity card or certificate as a precondition to entry, which it will do in a written announcement based on a separate decision on the matter. If the Operator adopts such a decision, it will publish its relevant information note on its website and display it prominently on its premises. In this case, presenting the immunity card will be mandatory as a precondition for entry during the period specified by the Operator.

10.6. Visitors may visit Bobo Fun Park only if they are in the appropriate health, physical and mental condition, and shall make a statement to the effect that they do not suffer from any infectious diseases nor have they been in close contact with anyone suffering from an infectious disease in the 14-day period prior to their visit. The Operator may ban visitors from entry if they do not comply with the conditions in this Section.

10.7. Visitors under the age of 10 must be supervised (accompanied) by an adult parent when visiting Bobo Fun Park. An exception to this is

All visitors in the 10-to-18-year age group will need a statement signed by a parent or carer as a precondition for using the services of Bobo Fun Park.

10.8. Visitors must be mindful of their own safety and that of others. The Operator shall not be held liable for injuries sustained by a Visitor due to the fault of the same or another Visitor. The Operator shall not be liable for injuries that Visitors may cause to one another. The Operator may pass on to Visitors the costs of wilful damage.

10.9. The Visitor acknowledges that there are preconditions for the use of certain play equipment, which are explained to Visitors in the Rules and Regulations, the GCTC and on site. Visitors shall not have the right to demand compensation for their failure to use services due to failing to satisfy the preconditions.

10.10. The play socks provided by Bobo Fun Park and designed specifically for these purposes must be used throughout Bobo Fun Park, except for on the climbing walls and the ropes course, where climbing shoes or indoor gym shoes are mandatory. Climbing shoes and gym shoes are not provided by Bobo Fun Park; Visitors must bring their own. Some play equipment cannot be used without climbing shoes or gym shoes.

10.11. The Operator takes all reasonable efforts to make operations secure and compliant with the regulations but it shall not be liable for losses caused by the failure or deficiency of specific components of the system. Visitors acknowledge that they shall not be entitled to compensation for the operating downtimes in the event of failures in play equipment.

10.12. Visitors must leave the play area when their 4-hour time slot ends. Please leave the restaurant and the reception area and empty your lockers within 20 minutes of the end of the 4-hour time slot. Fun Park staff will empty all lockers after closing time every day.

11. The rights and obligations of Visitors (as contracting party)

11.1. Having purchased their entrance ticket and handed in their completed Statement of Liability, Visitors shall be eligible to use Bob Fun Park to its stated purpose, in accordance with these GCTCs and the Rules and Regulations, as well as the legislation and the official restrictions in force at the time of their visit.

11.2. Visitors may file a complaint regarding the services provided by the Operator while they are on site at Bobo Fun Park. The Operator shall handle such complaints handed in to it (or drawn up by it in a report) in compliance with consumer protection regulations.

11.3. Visitors acknowledge that they shall use play equipment at their own risk, and that proper use also implies considerable physical exertion, with injuries also possible. Visitors also acknowledge that perspiration during play and the use of the equipment may result in a depletion of fluid levels, so that Visitors shall make sure that they replenish their fluids as appropriate and especially watch that minors in their care do so.

11.4. Visitors shall pay for the services they use and the products they purchase at the same time as using the services or buying the products but certainly no later than upon leaving.

11.5. Visitors shall make sure that children below the age of 10 under their supervision, care or guardianship shall be on the premises of Bobo Fun Park only if supervised by an adult throughout. Minors above the age of 10 may be in Bobo Fun Park only with the advance written permission of their legal representative, supervisor (e.g. teacher), or a Statement of Liability signed by their legal representative, or a person required by the law or other legal relationships, or authorised by the legal representative to supervise the minor.

12. The Visitor’s liability for damages

12.1. Visitors shall be liable for all damage and harm suffered by the Operator or third parties due to a reason attributable to a Visitor, a person accompanying a Visitor or other persons supervised by such accompanying person. Visitors shall compensate the Operator for the damage they cause (e.g. extra cleaning from HUF 20,000 gross). This liability shall also apply when the Injured Person demands damage recovery directly from the Operator.

13. The Operator’s rights

13.1. If a Visitor fails to pay the fee for services used or ordered but not used, the Operator shall be entitled to secure its claims by placing a charge on the personal effects the Visitor had brought to Bobo Fun Park.

13.2. The Operator shall have the right to reject a Visitor’s booking in the cases specified in the GCTC or the Rules and Regulations and ban the Visitor from Bobo Fun Park. (E.g. ticket fraud, incomplete data provision, improper use of equipment, disturbing other visitors, serious breach of Rules and Regulations, use of alcohol or psychedelics.) On request, the Operator will draw up a report of the circumstances, and shall manage that report in compliance with the rules on consumer complaint handling.

14. The Operator’s obligations

14.1. The Operator shall deliver ordered services in accordance with the legal and regulatory requirements, as amended from time to time, and its own commitment to standards of service.

14.2. The Operator shall record and investigate the complaints of Visitors in accordance with consumer protection legislation and take the measures necessary for handling such complaints.

15. The Operator’s liability for damages

15.1. The Operator shall be liable for all damage sustained by the Visitor on site at Bobo Fun Park due to a fault of the Operator or its employees.

15.2. The Operator’s liability shall not extend to claim events attributable to force majeure and reasons beyond the competence of its employees and Visitors or caused by Visitors themselves.

15.3. The Operator shall not be liable for damage caused by the inability or limited ability to use services due to restrictions by the authorities. Visitors acknowledge that they shall not be entitled to price reductions or reimbursement in such cases.

15.4. The Operator may designate places within Bobo Fun Park where Visitors are not permitted to enter. The Operator accepts no liability for damage or injury sustained at such places.

15.5. Visitors shall report any damage sustained by them at the reception desk of Bobo Fun Park and supply the Operator with all the information necessary to clarify the circumstances of the damage and, as the case may be, for a report/action by the police. Visitors explicitly acknowledge that the Operator shall not accept liability for damage reported after leaving the Park.

15.6. The Operator shall not be liable for valuables, cash and value instruments; the Operator does not offer a safe deposit service.

15.7. The Operator shall not be liable for personal effects left in the communal premises of Bobo Fun Park (including things/objects left in lockers).

15.8. The Operator shall not be liable for valuables left in vehicles in the parking lot; the Operator will investigate the cause of damage to vehicles sustained in the parking lot and, if the damage is attributable to its carelessness, it shall pay compensation.

15.9. Such compensation will capped at HUF 50,000 or the amount of the damage, whichever is lower.

16. Data protection, consumer rights

16.1. The Operator ascribes special importance to the protection of personal data in the course of its activities. It shall process the personal data provided to it in compliance with prevailing law at all times, ensuring their confidentiality and taking all the technical and organisational steps and developing all the procedural rules that are necessary for compliance with applicable legislation.

16.2. The Operator has summarised the information and its commitments relating to data processing in its Privacy Policy, which is published on the webpage www.bobofunpark.hu/en/privacy-policy and displayed at the reception desk of Bobo Fun Park at all times; it submits to the provisions therein as binding on itself. The Privacy Policy also includes information on the different data processing procedures. Its privacy notice regarding its video surveillance system is also displayed at the entrance to premises where video surveillance is used.

16.3. The notary of Alsópáhok village and the Zala County Megyei Consumer Protection Authority act as supervisors over the Operator’s service activities.

17. Force majeure

17.1. A reason or circumstance (for example war, fire, flood, unfavourable weather conditions, power failure, strike, epidemic or the imposition of official restrictions related to the above) that is beyond the control of either party (force majeure) shall exempt the parties from the performance of their obligations under the contract until such time as that reason or circumstance applies. The parties agree to do everything within their power to reduce the likelihood of the occurrence of such reasons and circumstances and remedy the resulting damage or delay as soon as possible.

18. Amending the GCTC

18.1. As the operator of Bobo Fun Park, Bobo Fun Park Kft maintains the right to amend the GCTC or its annexes at any time. The amended Rules and Regulations shall be published on the website www.bobofunpark.hu and displayed at the entrance to Bobo Fun Park from the date they enter into force.

19. Law governing the legal relationship between the parties, competent court

19.1. The legal relationship between the parties shall be governed by the provisions of the Civil Code of Hungary. The District Court or Regional Court with competence at the location of the services shall have jurisdiction over any disputes relating to the legal relationship between the parties.
